Terms of Service

These terms govern your use of the Savernake service. "Savernake", "we" and "us" mean Infinite Axis Ltd, a company registered in Scotland (company number SC789698, registered office 5 South Charlotte Street, Edinburgh EH2 4AN), trading as Savernake Solutions. "You" means the business subscribing to the service. By creating an account or using the service you agree to these terms on behalf of that business.
1. The service
1.1 Savernake provides market intelligence for booking-driven businesses: benchmarks, aggregates and analyses of pricing, availability, capacity and estimated demand ("Insights"), delivered through a web application, exports and reports.
1.2 Insights are derived estimates. They are produced by observing publicly available booking information and applying statistical methods described in our Methodology Statement. They are not guaranteed to be complete, exact or current, and coverage varies by sector, region and time. We report coverage honestly and update the service nightly in normal operation.
1.3 The service is business-to-business decision support. It is not financial, legal or investment advice, and you remain responsible for your own commercial decisions.
2. Accounts and tiers
2.1 You must provide accurate account information and keep credentials secure. Accounts are per business; named logins may be added subject to your tier.
2.2 Features, coverage, refresh frequency, watchlists and exports depend on your subscription tier as described on the pricing page. We may improve tiers at any time; we will not materially reduce what a paid tier includes during a paid-up period.
2.3 Free trials: where offered, trials run for 14 days and convert to the selected paid tier unless cancelled before the trial ends.
3. Fees and billing
3.1 Fees are billed in advance by card via our payment provider, monthly or annually per your selection, in pounds sterling and exclusive of VAT (added where applicable).
3.2 Annual subscriptions are discounted and non-refundable once the annual period begins, except where clause 9.3 applies.
3.3 You may cancel at any time with effect from the end of the current billing period. We do not offer pro-rata refunds for partial periods.
3.4 We may change prices with at least 30 days' notice, effective from your next renewal.
4. Your data and connected accounts
4.1 If you connect your own booking platform account by OAuth, you authorise us to read the data needed to show your own performance in the service. We act on your instructions in respect of that connected data, use it only to provide the service to you, and you may disconnect at any time, after which we stop collecting it.
4.2 You retain all rights in your connected data. We may derive anonymised, aggregated statistics from it only in a form that never identifies you or your business without written consent.
5. Our data and intellectual property
5.1 All intellectual property in the service, the underlying datasets, the derived analytics, the Insights and the software vests in Infinite Axis Ltd. You receive a non-exclusive, non-transferable licence to use Insights for your internal business purposes during your subscription.
5.2 You must not: resell, redistribute, publish or syndicate Insights or any substantial extract of them; use the service to build or train a competing product or dataset; scrape or bulk-export the service; or remove attribution from exported reports. Fair internal use, including sharing figures within your business and quoting individual figures in your own board or lender materials with attribution to Savernake, is permitted. The Acceptable Use Policy forms part of these terms.
6. Third-party operators shown in the service
6.1 Market data in the service concerns businesses that publicly advertise bookable services. It is presented as aggregates, bands and estimates, subject to the safeguards in our Methodology Statement, including thresholds that limit exact figures for identifiable individuals.
6.2 You must use market Insights lawfully. In particular you must not use them to harass any operator, to fix prices or coordinate conduct with competitors in breach of competition law, or to represent estimates as an operator's actual confidential figures.
7. Service levels
7.1 We target continuous availability but the service is provided "as available". Planned maintenance and upstream changes (including third-party platform changes that affect coverage) may interrupt or narrow the service. Material, sustained coverage loss affecting your sector will be notified in the app or by email.
8. Liability
8.1 Nothing in these terms excludes liability that cannot be excluded by law.
8.2 Subject to 8.1, we are not liable for: decisions you take in reliance on Insights; loss of profit, revenue or opportunity; or indirect or consequential loss.
8.3 Subject to 8.1 and 8.2, our total aggregate liability in any 12-month period is capped at the fees you paid for the service in that period.
9. Suspension and termination
9.1 We may suspend or terminate for material breach (including breach of the Acceptable Use Policy) with notice appropriate to the breach, or for non-payment after 14 days' notice.
9.2 You may terminate at any time under clause 3.3.
9.3 If we permanently discontinue the service, we will refund the unused portion of any annual prepayment.
9.4 On termination your licence to use Insights ends; exports made in-period for your internal records may be retained.
10. General
10.1 We may update these terms with 30 days' notice; continued use after the effective date is acceptance.
10.2 Neither party is liable for failure caused by events beyond reasonable control.
10.3 You may not assign these terms without consent; we may assign to a successor of the Savernake business.
10.4 These terms are the entire agreement regarding the service and supersede prior discussions.
10.5 Governing law and courts: Scots law; the Scottish courts have exclusive jurisdiction.
